Terms of Service

1. Agreement to Terms
These Terms of Service (“Terms”) govern access to and use of LexiStride (the “Service”), operated by LexiStride (“we,” “us”). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a school, district, or organization, you represent that you have authority to bind that organization, and “you” refers to both you and that organization.
2. Eligibility & accounts
The Service is intended for students, teachers, and administrators, including students under the age of 18. Where a student is under the age required to consent to online services in their jurisdiction, their account must be created and managed by a parent, legal guardian, or their school acting on behalf of a parent/guardian consistent with applicable law. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
3. Subscriptions & billing
LexiStride offers a free tier and paid subscription tiers (currently Premium and higher tiers as described on our pricing page) with features and pricing as posted at the time of purchase. Paid subscriptions renew automatically at the then-current price unless cancelled before the renewal date. School and district plans are governed by the specific order form or agreement executed with that institution, which controls over these Terms in the event of conflict. We may change pricing or features with reasonable advance notice; continued use after a price change constitutes acceptance for renewal terms going forward.
4. Acceptable use
You agree not to:
- Share your account credentials or allow another person to complete assessments on your behalf.
- Attempt to circumvent placement or quarterly test integrity measures (including copy-restriction, tab-switch, and fullscreen-exit detection used during timed assessments).
- Reverse engineer, scrape, or resell the Service or its content without written permission.
- Upload or transmit unlawful, harmful, or infringing content through any part of the Service, including the contact form.
- Interfere with the security or normal operation of the Service, including automated/bot submissions.
5. Content & intellectual property
The Service, including its software, design, Reading DNA methodology, and AI-assisted reading content, is owned by LexiStride or its licensors and is protected by intellectual property law. Reading articles may be generated or adapted with AI assistance from current news sources; underlying third-party news content remains the property of its original publisher and is used consistent with fair-use/educational-use principles for comprehension practice. You retain ownership of any content you submit (such as messages sent through our contact form), and grant us a license to use it to respond to and operate the Service.
6. School & district data
Where a school or district provides student roster or performance data to LexiStride, that institution represents it has the necessary rights and consents to share that data with us, and we process it as described in our Privacy Policy and any applicable data processing agreement.
7. Disclaimers
The Service is provided “as is” without warranties of any kind, express or implied. LexiStride does not guarantee specific score outcomes (e.g. SAT, TOEFL, IELTS) or Lexile growth, which depend on many factors outside our control including student effort and engagement.
8. Limitation of liability
To the maximum extent permitted by law, LexiStride will not be liable for indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months preceding the claim.
9. Termination
We may suspend or terminate access to the Service for violation of these Terms, non-payment, or as required by law. You may cancel a paid subscription at any time; access continues through the end of the paid period.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the effective date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
11. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, unless superseded by a specific school or district agreement.
